Large projects must also pay an upfront grid impact assessment fee to Eversource, National Grid, or municipal utilities to cover transmission upgrades, and agree to curtail load or switch to on-site batteries during ISO New England peak emergency events. Starting in 2027, operators will have to publicly report annual electricity use, water consumption for cooling, backup diesel runtime, and emissions intensity.

Facilities that fail to comply can be denied interconnection or face daily penalties, with exemptions only for small edge facilities, hospitals, and university research computing.

Why Lawmakers Pushed For Them Now

The push was driven by two colliding crises: skyrocketing electricity bills and a looming AI load surge.

Massachusetts residents already pay among the highest power rates in the country, and legislators were alarmed by projections from ISO New England showing regional data center demand could triple to over 5 gigawatts by 2030. Utility filings this spring showed more than a dozen hyperscale proposals scouting sites in Westfield, Devens, Fall River, and along the I-495 corridor, attracted by tax incentives and proximity to Boston's AI and biotech hubs.

Environmental justice groups, joined by Attorney General Andrea Campbell, warned that without action, Big Tech's power bills would be socialized onto households while jeopardizing the state's mandate to cut emissions 50% by 2030 and reach net-zero by 2050. A contentious legislative hearing in July featured testimony that a single 100-megawatt AI training facility can use as much power as 80,000 Massachusetts homes.

Governor Maura Healey, who backed the bill, framed it as a compromise: Massachusetts wants AI jobs and investment, but not at the cost of blackouts or backsliding on climate.

Third State In Three Months

Massachusetts is not acting alone. It is now the third state this summer to restrict data center growth over energy concerns.

In June, Indiana regulators approved a moratorium on new large-load interconnection agreements until utilities complete long-term grid impact studies, following backlash over a massive Amazon and Meta buildout around Indianapolis. In July, Texas passed its own law giving ERCOT authority to order large data centers to curtail power during grid emergencies and requiring them to disclose backup generation.

Virginia, home to the world's largest data center cluster in Loudoun County, is also debating similar clean power matching rules, while Oregon, Arizona, and Georgia have all launched legislative studies. Together, the moves mark a dramatic reversal from just two years ago, when states were racing to offer tax breaks to lure hyperscalers.

What It Means For Big Tech

For Amazon Web Services, Microsoft, Google, and Meta, all of which are racing to build AI-ready capacity in the Northeast, the Massachusetts law adds cost, complexity, and delay.

Industry group the Data Center Coalition warned the clean power matching requirement could add 15 to 25% to operating costs and make Massachusetts uncompetitive compared to states with looser rules. Developers may now be forced to directly fund new offshore wind, solar-plus-storage, or small modular nuclear projects in New England to meet their obligations, rather than simply buying cheap national renewable credits.

Some companies are already signaling a shift. Microsoft said it remains committed to its planned expansion in the state and to its 2030 carbon-negative goal, while AWS said it is reviewing the final language. Analysts say Big Tech may increasingly favor behind-the-meter gas plants with carbon capture or delay projects until more offshore wind comes online later this decade.

Smaller colocation providers and crypto miners are expected to be hit hardest, with at least two proposed projects in central Massachusetts reportedly paused since the bill passed.

Utilities Caught In The Middle

Utilities are giving the law cautious support. Eversource and National Grid have long warned that speculative data center interconnection requests, many of which never get built, are clogging the queue and forcing expensive grid planning for phantom load.

The new upfront fees and mandatory load disclosure should help them plan more accurately and shield residential ratepayers from paying for substations and transmission lines that primarily benefit tech giants. Both utilities are also positioning to sell data centers utility-scale clean power packages and battery curtailment services.

But municipal light plants, which serve about 15% of the state and had hoped data centers would bring revenue, say the 15-megawatt threshold is too low and could kill economic development in post-industrial towns eager for investment.

What Comes Next For The Clean Energy Transition

Clean energy advocates are calling the law a national model for aligning AI growth with decarbonization. By requiring additionality, meaning data centers must bring new clean power to the region rather than just claiming existing hydro or nuclear, Massachusetts hopes to ensure AI demand actually accelerates offshore wind and long-duration storage instead of crowding out homes and businesses.

Critics argue it could backfire, pushing developers to states with dirtier grids like West Virginia or Ohio, increasing overall emissions through leakage while costing Massachusetts jobs.

The real test comes next. Regulators have until March 2027 to finalize the detailed rules for clean power verification, curtailment protocols, and penalties. How strict those final standards are, and whether other Northeastern states copy them, will determine whether this becomes a speed bump or a fundamental rewiring of how America powers AI.
